HOUSTON — Texas Iron and Metal is facing a suit alleging its negligence led to a subcontractor being struck by a metal rod while unloading a truck. 

Roberto Montelongo filed a complaint Feb. 22 in Harris County District Court against Texas Iron and Metal Co., alleging negligence. 

Montelongo alleges in his complaint that he was hired by a store owner to do work on steel and metal beams. He claims on Oct. 1, 2020, while helping to load the metal into the back of the delivery truck, he bent down to pick up a metal rod that had fallen on the ground when another metal rod in the truck shifted. 

Montelongo alleges the metal rod struck him as he was in between the delivery truck and trailer and suffered "extensive and severe" injuries. He claims the defendants were negligent for not having the "proper safeguards" on the truck and failed to supervise their subcontractors. Montelongo also claims Texas Iron and Metal violated local, state and federal laws. 

Montelongo seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Nathan Yost of The Daspit Law Firm in Houston.
