HOUSTON — A couple claims they were frauduently sold a "high end" HVAC system that was not installed or designed correctly and does not perform as guaranteed.

Jonathan Harris and Judith Harris filed a complaint  March 8 in Harris County District Court against Unico Inc., and Texas SDHV Systems Company alleging breach of contract and breach of warranty, fraud, deceptive trade practices and negligence.

The plaintiffs allege in their suit that representatives from Unico came to their home at the beginning of a construction job to sell them a HVAC system and stated their systems were "well worth" the extra $30,000 more than a "traditional" HVAC system. They entered into a contract with Unico to install their HVAC system which they allege Unico claimed was specifically designed and installed for their home.

The Harris' claim the Unico system "neither performed as represented nor as intended" right after its installation. They further claim that inspections of the system found the design, equipment and installation were not correct for their home which  has caused them to suffer repairs and has left them with a so called "high-end" HVAC system that does not peform to its marketed standards.

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by Jerrad Bloome of Kane Russell Coleman & Logan in Houston.
