HOUSTON — The primary inventor of Shear Frac technology has filed a suit against his business partners alleging their efforts to seize control of the company and his intellectual property.
Wesley Johnson, Shear Frac Group LLC and Shear Frac Inc., filed a complaint March 22 in Harris County District Court against McMurray Capital Inc., Andrew McMurray, DC Phillips Geoscience LLC, Danny Phillips, Akokiniskyway Holdings Inc., Robert Dack, Johnston Geosciences LLC and Thomas Johnston alleging breach of fiduciary duty, breach of contract and civil conspiracy.
According to the plaintiff's suit, he is the "primary inventor" of an "advanced hydraulic fracturing-related technology" called Shear Frac and in 2019, formed the Shear Frac Group with the defendants to market the technology. The plaintiff alleges that the defendants have made "wrongful attempts to seize control of the company" in order to enrich themselves and deprive him of his benefits.
Specifically, the plaintiff alleges the defendants denied him access to company offices and records and on March 19, 2021, even had him removed from the business premises. He further alleges that the defendants cut off his company email and access and attempted to remove him as an officer of the company. In his suit, the plaintiff seeks a temporary restraining order to "preserve the status quo" and restore his access to company's records and intellectual property during the pending litigation.
The plaintiff seeks monetary relief of more than $1 million and all other just relief. He is represented by Andrew Hicks, Adam Dinnell, Daniel Hinde, and Bryan Zubay. of Schiffer Hicks Johnson PLLC in Houston.
