HOUSTON — A cargo delivery worker who was injured when a Port of Houston Authority crane operator slammed a container against his vehicle is claiming negligence.
Samuel Lopez-Calderon filed a complaint March 26 in Harris County District Court against the Port of Houston Authority.
The plaintiff claims in his suit that on Sept. 18, 2020, he was delivering cargo to the Port of Houston Authority on East Loop North in Houston. He alleges he came to a complete stop when "without warning," the Port Authority's crane operator slammed a container against his vehicle and caused him to suffer injuries.
The plaintiff claims the Port of Houston Authority's crane operator failed to "maintain a proper lookout" and failed to maintain attention."
The plaintiff also claims he suffered pain, mental anguish and impairment and incurred medical treatment expenses as a result of the crane operator's actions.
The plaintiff seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by David Mestemaker, Norman Straub and Jonathan Zumwalt of Mestemaker, Straub & Zumwalt in Houston.
