Houston attorney kept settlement funds from clients, suit alleges

HOUSTON — A Houston law firm which settled a case without their clients knowledge or consent and which failed to pay the whole settlement amount to their clients is facing a suit.

Rosa Maria Pacheco and Juan Pacheco filed a complaint  April 5 in Harris County District Court against The Guidry Law Firm alleging breach of contract. 

According to their suit, the plaintiffs hired the defendants in March of 2013 to handle the wrongful death case they filed after their daughter Amy was killed by a drunk driver. Also according to the Pacheco's complaint, the defendants and two other attorneys who were representing two other "severely injured parties" agreed to split the insurance policy limits of $1 million with each of the three claimants receiving one-third or $333,333. 

The Pachecos claim Guidry settled the case on their behalf "without their knowledge or consent," took the settlement money and never gave them any settlement funds. They further claim Guidry "falsely informed" them that no money was received relating to the case. In January of 2018, Guidry agreed to a $675,000 settlement with the Pachecos that included $7,500 monthly payments which they claim Guidry stopped paying in December of  2020.

The Pachecos seek monetary relief of more than $1 million, interest and all other just relief. They are represented by Ross Sears, II of Sears & Crawford LLP in Houston.
