Ferguson Law wins ‘remarkable’ $4 million settlement in 18-wheeler suit

BEAUMONT - A 48-year-old Buna man has recovered a $4 million settlement for neck injuries suffered in a collision with an 18-wheeler. 

The case, set for trial on April 12 in Beaumont federal court, settled the week prior. Paul ‘Chip’ Ferguson, Jr. of Beaumont’s The Ferguson Law Firm, LLP was lead counsel for the man.

The plaintiff was injured when an 18-wheeler pulled out in front of him on Highway 62 in Orange. He was taken to a local emergency room and discharged with no injury. Ultimately, he began having spinal pain that led to neck surgery. 

“Our client required a serious and complex spinal surgery to his cervical spine,” Ferguson said.  “It required multiple levels of his spinal bodies to be fused together and caused a tremendous amount of pain.” 

Despite his injuries, the man continued to maintain his employment with a local chemical plant.

“He was a highly motivated individual,” Ferguson added. “He had a wife and two young daughters to support. Even with high levels of pain and discomfort, he walked through that gate nearly every day to take care of his family. That speaks volumes about his character.”

Ferguson termed the $4 million recovery as “under our facts, remarkable.” He also gave high marks to his team: Cody Dishon and Samantha Leifeste of The Ferguson Law Farm and Marianne Laine of Clark Hill PLC. 

“There was a lot of hard work put in by Cody, Samantha and Marianne. And it was very, very good work,” Ferguson said. “Of course, the true heroes were our staff. Ashlie Allen, Melissa Wesolowski and Jessica Burkett made sure everything that needed to be done got done. This is just one example of why they are the best in the business. I have never had a staff as good or as hard-working as them.”

The defendant in this case was a very large transportation company out of the Midwest. 

“They challenged anything and everything,” said Ferguson. “But we answered every punch with one of our own. Sometimes, two or three. And, in the end, justice prevailed, and our client was compensated. Nothing is more important, and nothing is more satisfying, that to see a great result for a deserving client. That happened here.”

The Ferguson Law result adds to the already-impressive list of record-setting results achieved by the law firm during 2021.
