HOUSTON — A man claims his wheelchair became stuck on tape on the floor of a Houston urgent care clinic which caused him to flip backwards and hit the ground.

Emilio Zamura filed a complaint April 12 in Harris County District Court against Convenient Urgent Care alleging negligence.

Zamura alleges in his complaint that he was at the Convenient Urgent Care in Houston on March 15, 2021. He claims that as he was rolling out of the clinic on a wheelchair and into the lobby, the wheelchair wheels became stuck "on a transition strip on the floor" and caused him to flip backwards and onto the ground.

Zamura alleges he suffered head, neck and back injuries as a result of the accident and that the defendant was negligent for failing to post any warning or caution signs in the area. He further alleges the defendant failed to inspect its premises or take precautions to "safeguard" the premises. Zamura claims in addition to the physical and mental suffering, he also incurred medical expenses as a result of the fall.

Zamura seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Nathan Surprise and John Daspit of The Daspit Law Firm in Houston.
