Woman alleges surgeon damaged bile duct during gallbladder removal, sues for $1M

HOUSTON — A woman alleges a surgeon damaged her bile duct during a laparoscopic procedure to remove her gallbladder. 

Yenny Marcos filed a complaint April 19 in Harris County District Court against Nicholas Stephens, M.D., and Nicholas Stephens, M.D., PLLC alleging negligence. 

According to her complaint, Marcos underwent a laparoscopic cholecystectomy on Aug. 22, 2019, performed by Stephens. She alleges that on Sept. 9, 2019, she had to be admitted to the hospital and was diagnosed with "a common bile duct leak." 

She further alleges that the leak was due to a "hepatic duct transection" which happened during her cholecystectomy that was peformed by Stephens. Marcos also alleges that she had to undergo further surgeries to repair her bile duct damage which was caused by Stephens and claims Stephens was negligent in failing to properly "identify the common bile duct/and or common hepatic duct prior to transecting."  

Marcos seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Gregory Feste and Tommy Hastings of The Hastings Law Firm PC in The Woodlands.
