$10M suit alleges intoxicated patron fell on top of woman at Molly's Pub

HOUSTON — A woman who was knocked to the ground and suffered serious injuries after an intoxicated man at Houston bar fell on top of her is suing for $10 million in damages.

Eileen Kay filed a complaint April 17 in Harris County District Court against Brobe Inc., doing business as Molly's Pub, Findal Inc., and James Joseph Scheurich alleging negligence. 

According to her complaint, Kay was a patron at Molly's Pub on Ramada Drive in Houston on April 1, 2021. She alleges that Scheurich was also a patron at the pub during that time and "was obviously intoxicated" and "presented a clear danger to himself and to others." 

Kay claims that Scheurich was so drunk that he was "unable to maintain a steady footing and balance" and fell on top of her. Kay claims she was knocked to the ground and suffered "serious bodily injuries" along with mental anguish, physical impairment, loss of earnings as well as incurred medical treatment expenses. 

She claims that the defendants illegally and negligently continued to provide Scheurich with alcohol when it was obvious he was intoxicated. 

Kay seeks monetary relief between $1 million and $10 million, interest, trial by jury and all other just relief.
