Classic Chevrolet has summary judgment win affirmed

HOUSTON – A summary judgment win in favor of Classic Chevrolet was recently affirmed on appeal. The finding stems from an automobile collision lawsuit brought by Jenny Day and Guillermo Moreno.

The plaintiffs allege that on Aug. 25, 2015, they were traveling northbound on Highway 45 when Arthur Maxwell Jr., who was driving a car he had rented from Classic in Galveston, rear-ended them and knocked them into the guard rails.

The plaintiffs accused Classic of negligent entrustment and sought actual and exemplary damages from the company, court records show.

Classic moved for summary judgment, arguing that Maxwell had presented a valid Texas driver’s license when he took possession of the rental car.

On April 27, the First Court of Appeals concluded Classic conclusively negated at least one essential element of the plaintiffs’ negligent entrustment claims, entitling the company to judgment on that claim as a matter of law.
