Driver injured when road grading metal flies into windshield, suit claims

HOUSTON — The Texas Department of Transportation is facing a negligence claim after a piece of grating on Highway 146 came off the road and flew into a driver's windshield.  

Jose Gonzalez filed a complaint April 28 in Harris County District Court against Texas Department of Transportation alleging negligence. 

Gonzalez alleges in his complaint that on July 10, 2020, while driving his vehicle on Highway 146 towards Baytown, "a piece of metal came flying from the freeway" and went through his front windshield. 

He claims the metal piece came from the highway grating and caused him to suffer serious injuries. Gonzalez alleges the Texas Department of Transportation was negligent in failing to inspect and maintain Highway 146 and as a result, the metal piece came off the road and flew into his car windshield. 

Gonzalez seeks monetary relief of $1 million, interest, trial by jury and all other just relief. He is represented by Jose Orihuela and Danielle Garcia of Orihuela & Associates PLLC in League City.
