HOUSTON — A Harris County man claims a Cadillac dealership accepted his downpayment for a custom vehicle and then sold the car to another customer.

Ali Mokaram filed a complaint April 28 in Harris County District Court against GPI TX-HGM Inc., doing business as Sterling McCall Cadillac, Group 1 Automotive, David Taylor Motors Inc., and Jessie Ledet alleging violation of the Texas Deceptive Trade Practices-Consumer Protection Act and fraud.

According to his complaint, Mokaram made a down payment to the defendants for a "custom" Cadillac Escalade on July 13, 2020. He alleges that he was later notified by the defendants that the "specific vehicle" he ordered had been sold. Mokaram claims the current market value for the vehicle is in excess of its MSRP and that the defendants sold the vehicle for a "greater value" then what was offered to him.

He further claims the defendants actions were in violation of the Texas Deceptive Trade Practices-Consumer Protection Act and that they breached their duty and made misrepresentations about the vehicle in order to get him to sign the contract for the purchase of the custom Cadillac.

Mokaram seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Husein Hadi, Jamil Thomas, Carnegie Mims, III, Sedrick Stagg and Steve Thomas of The Hadi Law Firm PLLC in Houston.
