HOUSTON — A man is seeking $1 million in damages after allegedly slipping and falling on a slippery floor at a Houston Kroger.

Gary Ferguson filed a complaint May 3 in Harris County District Court against Kroger Texas LP doing business as Kroger Houston 392, The Kroger Co doing buisness as Kroger Houston 392, Kroger Houston 392 and Philip Ingram alleging  premises liability and negligence.

Ferguson alleges that he was at a Houston Kroger on Oct. 15, 2019, when he slipped and fell on a "slippery substance" on the floor and suffered injuries. He claims he has suffered physical impairment, disability, lost earnings as well as incurred medical care expenses.

Ferguson alleges in his complaint that the defendants "were aware and on notice" regarding the hazardous condition and had a "sufficient period of time to have eliminated it." He further alleges the defendants failed to inspect and keep their premises safe and failed to "provide sufficient warning" of the dangerous condition.

Ferguson seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by David Mestemaker,  Norman Straub and Jonathan Zumwalt of Mestemaker, Straub & Zumwalt in Houston.
