HOUSTON — A Union Pacific Railroad conductor who tripped on exposed conduit on the track and suffered serious injuries is claiming the company failed to abide by Federal Railroad Administration safety guidelines.

Kevin Robertson filed a complaint May 17 in Harris County District Court against Union Pacific Railroad Company alleging negligence and violation of railroad safety statues and regulations.

Robertson alleges in his complaint that on April 26, 2021, while working as a conductor for Union Pacific, he was "building a train off the mainline" in Orange. He claims he tripped over an "exposed conduit laid in the track bed" while walking back to the locomotive and suffered injuries to his ankle, knee and lower back. Robertson claims Union Pacific failed to warn of  the hazard and ensure that the track and track bed were maintained. He also claims Union Pacific failed to properly train and supervise its employees and violated Federal Railroad Administration regulations by not enacting safety standards and providing a reasonably safe work place.

Robertson seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Anthony Buzbee, Ryan Pigg and Cornelia Brandfield-Harvey of The Buzbee Law Firm in Houston.
