Lawsuit: trailer bumper flies off and injures former American Plant Food worker

HOUSTON — American Plant Food is facing a suit after one of its former workers suffered severe injuries when a trailer bumper flew off and landed on him at its Galena Park facillity.

Alexander Delk filed a complaint May 26 in Harris County District Court against American Plant Flood Corporation alleging negligence. 

Delk was working at the American Plant Food facility in Galena Park on Nov. 19, 2020, according to her complaint. He claims that as he was working near an "elevated trailer," the bumper came off and "launched into the air," and fell down on him and caused him to suffer "career ending injuries." 

Delk claims his injuries were the result of American Plant's negligence in failing to provide a safe work site and failing to "properly plan and engineer" in the area where he was working. He further claims American Plant Food failed to warn or notify him of the "structural weakness" of the trailer and equipment or put safety procedures in place. 

Delk seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Byron Alfred and Johnny Alfred, III of The Alfred Law Firm in Houston.
