Contractor suffers burns from hot oil filter at food plant, $1M suit claims

HOUSTON — A contractor who suffered severe burns at a Harris County food plant when he was sprayed with hot oil from a filter is claiming the negligence of another contractor who was also working at the site. 

Hernaldo Rodriguez filed a complaint June 1 in Harris County District Court against Heat and Control Inc., alleging negligence. 

According to his complaint, Rodriguez was working at an HEB snack plant in Harris County on Feb. 24, 2021, with Heat and Control also working at the site. He alleges that Heat and Control "closed a valve in close proximity" to the filter he had opened when hot oil sprayed from the filter and caused him to suffer burns to approximately 20 percent of his "total body surface area" including his face. 

Rodriguez claims Heat and Control created the hazard at the site and failed to warn him of the danger. He also claims Heat and Control failed to "exercise ordinary care" and failed to make the site safe for others. 

Rodriguez seeks monetary relief between $200,000 and $1 million, interest, trial by jury and all other just relief. He is represented by J. Moises Cedillos of The Cedillos Law Firm PLLC in Houston.
