$1M suit alleges woman tripped over oxygen cord in patient's room

HOUSTON — Capstone-Houston OPCO faces a lawsuit after a woman allegedly tripped over an exposed oxygen cord in a patient's room at their facility. 

Prenise Howard filed a complaint June 7 in Harris County District Court against Capstone-Houston OPCO LLC alleging negligence. 

Howard claims that on Dec. 7, 2019, she was in a patient's room at the defendant's facility when she tripped over "a misplaced oxygen tank cord." She alleges she fell and suffered "serious and permanent" injuries to her face, eyes, neck and back. 

Howard claims in her complaint that the defendants were negligent for failing to have routine maintenance and safety checks of the rooms, failed to notice or remove the exposed cords and failed to have warning signs or take other preventative measures to avoid the trip hazard. 

She alleges that as a result of her fall, she suffered pain, physical impairment, disfigurement, loss of earnings and incurred medical treatment expenses. 

Howard seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief.
