Man walks in on woman in dressing room at Academy and is assaulted, claims broken lock caused incident

HOUSTON — A customer at an Academy Sports + Outdoors store claims he suffered injuries when he attempted to enter an occupied dressing room that had a vacancy display and a broken lock. 

Jose David Martinez and Fabiola Mendez Patino filed a complaint  June 16 in Harris County District Court against Academy LTD doing business as Academy Sports + Outdoors alleging negligence and premises liability. 

Martinez alleges in his complaint that he was at the Academy Sports + Outdoors store on Spring Cypress Road in Spring on June 16, 2019, when he attempted to go into a unisex dressing room stall to try on clothes. He claims the stall door said "vacant" and the lock on the door was broken and defective. 

Martinez alleges that unbeknownst to him, the room was occupied by a female customer whose family member then injured him for trying to get into the stall. He claims he suffered pain, disfigurement and impairment as a result of his injuries and incurred medical expenses. Martinez claims the negligence of Academy Sports + Outdoors for failing to make a reasonable investigation into the incident, failing to provide security or control their premises. 

Martinez seeks monetary relief of more than $250,000, trial by jury and all other just relief. He is represented by Corey Gomel and Maxey Scherr of Gomel & Associates PC in Houston.
