Houston chiropractic clinic charged unreasonable rates, suit alleges

HOUSTON — A Houston chiropractic practice is facing a suit alleging they failed to charge reasonable and regular rates of service for treatment of a woman's auto accident injuries.

Yesenia Barrientos filed a complaint June 23 in Harris County District Court against Yars Chiropractic & Nutrition alleging violation of the Texas Deceptive Trade Practices Act and Texas Debt Collection Act. 

Barrientos alleges in her complaint that she was injured in an auto accident on May 14, 2019, due to the neglience of another driver and sought chiropractic treatments from Yars. She claims that her attorney "submitted a letter of protection" to Yars explaining that she had no health insurance and that she would agree to pay for treatments after the finalization of her insurance claim. 

Barrientos further claims Yars accepted those conditions which also included notifying her attorney of any outstanding treatment bills. In January of 2021, her attorney requested Yars reduce their treatment bill of $10,490 by $3,000 which represented one-third of her insurance settlement proceeds, according to her complaint.  She claims Yars refused to reduce their fees and still demanded "well over the one-third share set aside for medical expenses" and that Yars treatment of her injuries exceeded the "normal treatment standards."

Barrientos seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Andrew Piekalkiewicz of The Law Offices of Andrew Pike Piekalkiewicz in Houston.
