Couple claims new home has numerous construction defects

HOUSTON — A couple is suing a contractor they paid more than $200,000 to build their new home which they claim has numerous construction defects. 

Stephanie and Mitchell Pate filed a complaint June 24 in Harris County District Court against Admired Construction & Roofing Corp., Cross Creek Custom Builders and John Villarreal alleging breach of contract, violation of the Texas Deceptive Trade Practices Act, theft, fraud, negligence and other claims. 

According to their complaint, the plaintiffs own land in Crosby and due to multiple hurricane flooding of their house and land, they wanted to rebuild a house on the same property but elevate the new home on stilts. They hired the defendants to build their new home for an estimated cost of $238,000 and paid the defendants at least $200,462.50. 

The Pates claim that the defendants assured them the design and construction of their new home would be safe from future flooding, however after moving into their home, they discovered "numerous problems" including a roof leak, improperly installed wood square pilings for the stilts foundation, wood and sheet rock damage and lack of "hurricane chips" that were supposed to be installed in the roof. The Pates allege they have "tried every form of communication" to get in contact with the defendant who has ignored them. 

The Pates seeks monetary relief between $100,000 and $200,000, interest and all other just relief. They are represented by John Venzke of The Venzke Law Firm PC in Bellaire.
