Delivery driver falls off tank at oil well site, sues for $1M

HOUSTON — A delivery driver alleges he was injured after falling off a tank at a oil well drilling site.

Mario Sanchez filed a complaint June 30 in Harris County District Court against Luxe Operating LLC and Nabors Industries Inc., alleging neglience. 

Sanchez, who was employed by Redline Hot Shot & Transportation, was driving an 18-wheeler to a Texas oil well site where Nabors was the drilling contractor, according to his suit. He alleges that while delivering brine water for one of the portable tanks on the site, he noticed the tank was overflowing and had to "rush" to shut off the water when he fell and hit the ladder railing and "slammed" into the manifold and then onto the ground. 

Sanchez claims he suffered injuries to his knee and shoulder and requires surgery for medical treatment. He further claims that normally Nabors has workers to assist him with the tanks and to ensure the off-loading is done safely, but on the date of his accident, he had no assistance. Sanchez also claims Nabors failed to clearly mark the empty tank that he was supposed to fill and did not provide a safe means to access his work area. 

Sanchez seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by C. Brannon Robertson and Nicholas Fernelius of Fernelius Simon Mace Robertson Perdue PLLC in Houston.
