Woman trips in parking lot of Houston 24 hour fitness center, sues for $250K

HOUSTON — A woman who tripped in the parking lot of a Houston 24 hour fitness center and suffered injuries is claiming negligence. 

Denise Landeis filed a complaint https://s3.amazonaws.com/jnswire/jns-media/41/42/11573082/96659429.PDF July 2 in Harris County District Court against 21614 Tomball LLC alleging negligence. 

Landeis claims in her suit that as she was leaving her fitness class on the defendant's premises on July 15, 2019, she tripped and fell over a "hole/uneven" surface in the parking lot. She alleges as a result of her fall, she suffered injuries including disability, disfigurement, mental anguish, loss of earnings and physical impairment. Landeis also alleges she incurred medical expenses for treatment of her injuries and that the defendant "allowed the creation and continued existence" of the dangerous condition. 

She further alleges the defendant was negligence in failing to warn of the hazard despite its employees knowing "or in the exercise of ordinary care" should have known of the dangerous condition. 

Landeis seeks monetary relief of less than $250,000, interest and all other just relief. She is represented by Adam Criaco of Criaco & Associates in Houston.
