Patient dropped during wheelchair transfer files lawsuit

HOUSTON — A former long term care facility patient who suffered a fractured ankle after being dropped during a wheelchair transfer is claiming negligence. 

Leila Ewert filed a complaint July 6 in Harris County District Court against The Courtyards at Pasadena, Red Bluff LLC and Fundamental Long Term Care Inc., alleging corporate and medical negligence and other claims. 

Ewert was a patient at the defendants' facility on April 12, 2020, according to her complaint. She alleges that as a caregiver at the facility was helping her transfer to a wheelchair, she was dropped and suffered a fractured ankle. 

Ewert alleges as she stood up to be transferred to the wheelchair, she asked the caregiver "are you sure you have me?" and that the caregiver replied "yes." She also alleges that patient transfer is usually done with the assistance of two caregivers and that the defendants failed to have enough healthcare workers at the facility to provide the necessary level of care. Ewert further alleges the defendants failed to provide her with a comprehensive assessment or care plan to meet her needs or prevent her fall. 

Ewert seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Ryan Luna, Dominic Braus, J.T. Borah and Johan Holter of The Carlson Law Firm PC in Waco.
