Sports bar patron alleges he was peppered sprayed by security officer, sues for $1M plus

HOUSTON — A man claims he was negligently pepper sprayed by a security guard at Ojos Locos Sports Cantina in Houston. 

Nester Perez filed a complaint July 6 in Harris County District Court against OL Houston LLC doing business as Ojos Locos Sports Cantina, John Doe and Dallas Protection and Patrol Services alleging negligence, premises liability and vicarious liability. 

According to Perez's complaint, he was at Ojos Locos Sports Cantina on North Freeway in Houston on June 23, 2021. He claims that Doe, who was employed as a security officer with Dallas County Protection and Patrol pepper sprayed him and caused him to suffer personal injuries. 

Perez alleges Doe's negligence for assault and for his failure to "adequately resolve dangerous conditions" or follow proper emergency response procedures. He also claims Ojos Locos failed to provide adequate security or protect its patrons from hazards or warn of the danger. Perez further claims Dallas Protection and Patrol failed to properly train and supervise its employees and was negligent in its hiring of its security officers. 

Perez seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Richard Presutti, Meredith Smith and Anthony Presutti of The Law Office of Richard J. Presutti PC in Houston.
