Attorney sues restaurant after waitress allegedly kicks him in the foot while delivering food

HOUSTON — An attorney is suing a Houston restaurant alleging battery after a waitress kicked him in the foot while trying to deliver a tray of food to other customers. 

Benjamin Karimi filed a complaint against Empire Cafe on July 6 in Harris County District Court. 

Karimi, an attorney in the Houston area, was a customer at the Empire Cafe on June 6, 2021, and was sitting at a table in the restaurant's outdoor area, according to his complaint. 

He alleges that as he went inside the restaurant to refill his drink, a waitress "in a hurry to deliver food" approached the door that he was coming through. Karmi claims he tried to step aside to let her through while she kept attempting to go around him and that the waitress finally "decided to go without regard" to him and kicked him in the foot. 

He alleges the waitress' "offensive contact" made him feel "disrespected, embarrassed and offended." 

Karimi is representing himself.
