Justices affirm dismissal of sexual assault case against Waller County

HOUSTON – The First Court of Appeals recently affirmed the dismissal of a sexual abuse lawsuit against Waller County and its Sheriff’s Department.

The lawsuit was brought by Troylencia Wolf Anderson, who claims that on Oct. 19, 2014 she was incarcerated at the Waller County Jail and left with only a blanket to cover herself.

When she noticed a camera in the upper corner of the cell, Anderson smeared mayonnaise on the lens “to block people from seeing her.” She then alleges she was drugged and assaulted.

Court records show Waller County denied the allegations and filed a plea to the jurisdiction, arguing that it had governmental immunity and the Texas Tort Claims Act did not waive that immunity.

The trial court granted Waller County’s amended plea and Anderson unsuccessfully moved for a new trial, leading her to appeal.

On July 20, the First Court found that the trial court did not error in granting the amended plea and dismissing Anderson’s claims with prejudice.
