Court records show Duc Dinh sued woman accusing him or rape for defamation before she filed her lawsuit

HOUSTON – Court records show that Duc Dinh, a well-known member of the Houston-area Vietnamese community, had sued Gina Nguyen for defamation prior to being hit with a lawsuit accusing him of rape.

As previously reported, Jane Doe filed suit against Dinh and Duc Dinh International earlier this month, seeking more than $1 million in damages.

While her suit only identifies her as Jane Doe, the litigation does allege that on Nov. 3, 2018, Dinh invited her to go bar hopping when she was only 19 years old. He then took her back to a hotel and raped her.

Dinh’s defamation lawsuit, filed back in October 2020, describes a very different account of what transpired on Nov. 3, 2018. 

Dinh alleges that he and Nguyen had consensual sexual relations but that her cousin, Karan Dang, had sent Nguyen a text indicating that she was going to call the police. The police did arrive at the hotel after Dinh and Nguyen had sex and interviewed them both.

“While Mr. Dihn was not present during Ms. Nguyen’s interview, he told the police that everything that happened between him and Ms. Nguyen was consensual,” the suit states. “After the police interviewed Ms. Nguyen, outside the presence of Mr. Dihn, they told both they were free to go, as they didn’t see anything illegal about the encounter.

“When Mr. Dihn went outside, he saw Ms. Dang outside. Ms. Nguyen went outside and got inside Ms. Dang’s car to go home with her.”

In June 2020, Nguyen began a social media campaign against Dinh and started posting lies about him, according to the suit.

Court records show Nguyen’s motion to dismiss was denied back in April.

In his suit against Nguyen, Dinh is represented by Houston attorney Dean Blumrosen Esq. Case No. 2020-67616.

In the lawsuit against Dinh, plaintiff Doe is represented by Andrew Dao and Ajay Ketkar of Daly & Black, and Megan Daic of Daic Law.
