Apartment complex moves suit over minor’s drowning death to Fort Bend County

HOUSTON — A man suing the owners and managers of a Harris County apartment complex alleging over his son's drowning death recently had his lawsuit transferred to Fort Bend County.

Jeffery Sobre filed a complaint March 22 in Harris County District Court against The Terraces at Arboretum LP., The Terraces at Arboretum GP LLC and Atlantic Pacific Community Management LLC alleging negligence and wrongful death.

Court records show that on May 17 the defendants filed an answer asserting contributory negligence.

The defendants also filed a motion to transfer venue, arguing that the incident occurred in Fort Bend County.

On July 14, the trial court granted the motion to transfer venue, moving the case from Harris County to Fort Bend County.

In his complaint, Sobre alleges that the negligence of the defendants led to his son's drowning death on April 28, 2020, at the swimming pool located at the Terrace at Arboretum apartment complex. 

Sobre claims the defendants were negligent in failing to maintain the pool gate or enclosures at the apartment complex and failed to properly train and supervise its employees.

Sobre also claims the defendants failed to provide adequate safety equipment, to enforce safety procedures or take "action to protect" his son.

Sobre seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief.

He is represented by Jason Itkin, Noah Wexler and Ben Bireley of Arnold & Itkin LLP in Houston.
