Lawsuit lender’s $6M summary judgment win against attorney Gregg Price affirmed on appeal

HOUSTON – Today the First Court of Appeals affirmed a summary judgment win in favor of Virage in litigation the lawsuit lender brought against attorney B. Gregg Price and his law firm.

In 2019, Virage sued the law firm for breach of a promissory note and Price for breach of a guaranty.

Court records show Virage loaned the law firm more than $3.2 million. When the firm’s cases settled, Price failed to pay Virage back.

Virage moved for summary judgment and on April 2, 2020, the trial court granted the litigation funder summary judgment, awarding it more than $6 million in principal and interest.

When the trial court failed to grant the firm a new trial, Price appealed, arguing the trial court erred in granting Virage summary judgment and in striking the firm’s summary judgment response.

“In sum, we hold that the trial court did not abuse its discretion in denying the Law Firm and Price’s motion for new trial on the asserted grounds,” the opinion states. “We affirm the trial court’s judgment.” 

Price is represented by Steven Sanfelippo, attorney for the Dallas law firm of Cunningham Swaim, along with Dallas attorney John Eichman.

Houston attorneys Ashish Mahendru and Darren Braun represent Virage.
