Suit alleges Union Pacific conductor injured in locomotive, tractor trailer crash a

HOUSTON — A Union Pacific conductor is alleging negligence after a tractor trailer pulled into his locomotive's path.  

Andrew Havins filed a complaint July 26 in Harris County District Court against National Drayage Services LLC, Direct Chassislink Inc., doing business as CLI/LJ Chassis Holding Inc., Progress Rail Services Corporation, Juan Carlos Luna Arroyo and Union Pacific Railroad Company alleging negligence. 

Havins was working as a conductor for Union Pacific near Waskom on Feb. 3, 2021, according to his complaint. He alleges that the locomotive he was working on collided with the tractor-trailer truck driven by Arroyo when Arroyo pulled the truck onto the crossing and into his path. 

Havins claims as a result of the collision he suffered injuries to his knees, ribs and other parts of his body. He also claims he suffered lost earnings, impairment, disfigurement and incurred medical expenses as a result of the accident. Havins alleges Arroyo was negligent for failing to yield the right of way to the approaching train and failed to come to a complete stop at the stop sign posted at the crossing. He alleges Union Pacific failed to warn him of the dangers or to properly instruct and train him on safety procedures and that National Drayage failed to properly screen their truck driver. 

Havins seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Sara Youngdahl of The Youngdahl Law Firm PC in Houston.
