HOUSTON — Murphy Oil is facing a negligence claim from a man who slipped on a liquid substance at one of its gas stations in Baytown and struck his head on his vehicle.

Thomas Donald filed a complaint Aug. 10 in Harris County District Court against Murphy Oil USA Inc., alleging negligence.

According to Donald's complaint, he was at a gas station owned by Murphy Oil on July 29, 2021, on Garth Road in Baytown. He alleges that as he stepped out of his vehicle, he slipped on "a liquid substance on the ground" which caused him to fall and strike his head against his car.

Donald claims as a result of the fall, he suffered "significant injuries" as well as incurred medical and pharmaceutical expenses. He alleges Murphy Oil was negligent for failing to maintain its station in a safe condition or inspect its premises. Donald also alleges Murphy Oil failed to "fix the condition" or warn him of the hazard that existed on their premises.

Donald seeks monetary relief of more than $75,000, interest, trial by jury and all other just relief. He is represented by Benjamin Fairleigh of The Daspit Law Firm in Houston.
