Woman allegedly trips over skateboard left in aisle at Houston Burlington store, sues for $1M

HOUSTON — Burlington Coat Factory is facing a negligence claim after a customer tripped and fell over a skateboard that had been left in the aisle at its Houston store. 

Paula Delgadillo filed a complaint Aug. 10 in Harris County District Court against Burlington Coat Factory of Texas Inc., alleging negligence. 

Delgadillo was shopping at the Burlington store on FM 1960 Road in Harris County on July 18, 2021, according to her suit. She alleges that she tripped on a skateboard that had been left on the floor of one of the aisles and suffered severe injuries. 

Delgadillo claims Burlington was negligent for failing to make necessary safety inspections of its premises and failed to warn of the dangerous condition. She alleges that as a result of her fall, she suffered lost wages and earning capacity, disfigurement, impairment and emotional distress that has caused "loss of enjoyment of life." 

Delgadillo seeks monetary relief between $200,000 and $1 million, interest, trial by jury and all other just relief. She is represented by J. Moises Cedillos of The Cedillos Law Firm PLLC in Houston.
