Luxury vacation planner claims island resort misrepresented accommodation size, sues for $1M plus

HOUSTON — A custom, luxury vacation planner for high end clients is suing the owners of a resort located on Bolifushi Island in the Maldives alleging violation of the Texas Deceptive Trade Practices Act. 

Gregory Patrick filed a complaint  Aug. 18 in Harris County District Court against Atmosphere Hotels & Resorts alleging violation of the Texas Deceptive Trade Practices Act.

According to Patrick's complaint, he specializes in designing custom vacations "for high net worth clients." He alleges that he visited the defendant's Ozen Reserve Boilfushi (ORB) to consider booking accommodations for one of his clients. Patrick claims the defendant fraudulently misrepresented the square footage of its "private ocean reserve over-the water villas" and that he had relied on the defendant's representation to book the villa for a client in January of 2021. 

Patrick alleges the private ocean reserve was not the advertised 6,566 square feet and that his client could not fit its entire party "within the small confines" of the villa which caused him to suffer "financial and reputational damage." He further alleges that the defendant also misrepresented the private boat transfer from the shore to the villas including on their website's virtual tour in violation of the Deceptive Trade Pratices Act. 

Patrick seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Brandon Cook of Gunn, Lee & Cave PC in San Antonio.
