Woman alleges assault by Houston apartment complex maintenance worker

HOUSTON — A woman alleges she was assaulted by a maintenance crew member at a Houston apartment complex. 

Annastasia Stewart filed a complaint Sept. 6 in Harris County District Court against Comcapp Wilshire LLC doing business as Carmel Creek Apartments and John Doe alleging negligence, premises liability, invasion of privacy and other claims. 

Stewart was a resident of Carmel Creek Apartments located on Hollister Street in Houston. She claims that April 10, 2021, Doe, a male maintenance employee at Carmel Creek, knocked "fiercely" on her door and claimed there was a leak downstairs that required him to check her pipes. She claims Doe then assaulted her and caused her to suffer mental anguish and other injuries as well as incur medical expenses. 

Stewart alleges that the defendant failed to keep and maintain security systems, failed to train its employees or reasonably investigate the incident and prior incidents. She also alleges the defendant did not vet its employees and did not maintain control over key codes and other instruments that prevent individuals from entering restricted areas.

Stewart seeks monetary relief of more than $1 million and all other just relief. She is represented by Ciro Samperi of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner in Houston and Nicholas Fleming of Fleming Law PC in Houston.
