Construction company without workers' comp insurance faces suit over worker's injuries

HOUSTON — A residential home improvement contractor who does not subscribe to workers compensation insurance is facing a negligence claim after one of his workers suffered injuries while on a job site. 

Farid Enrique Pereira Ortiz filed a complaint Sept. 4 in Harris County District Court against Consider It Done Residential Improvements Inc., and Donald Erhardt alleging negligence and vicarious liability. 

Ortiz claims that while working on a project for the defendants on June 22, he suffered injuries. He alleges that as a result of those injuries, he suffered physical impairment, disfigurement, mental anguish, loss of earning capacity and incurred medical expenses. 

Ortiz claims the defendants are non subscribers to workers' compensation insurance and that his injuries were the result of defendants' failure to exercise reasonable care to avoid his risk of injury. 

Ortiz seeks monetary relief of less than $250,000, interest, trial by jury and all other just relief. He is represented by Stephen Walker, Gregory Finney, Juan Solis and Austin Gunnels of The Law Offices of Manuel Solis PC in Houston.
