Roofing manufacturer accused of failing to honor warranty

HOUSTON — A property owner in Spring is alleging a roofing manufacturer violated state law by failing to honor his roof warranty. 

Daniel Eichenour filed a complaint Sept. 13 in Harris County District Court against Tamko Building Products LLC alleging violation of the Texas Deceptive Trade Practices Act.

According to his complaint, Eichenour had a Tamko Lamarite Slate roof installed on his home on Craigway Road in Spring in June of 2007. He alleges that he paid the defendant $32,450 for the roof which included a 50-year warranty. Eichenour claims the roof has had "numerous failures" and required replacement at a cost of $14,900 and that Tamko has ignored claims and damages noted in a letter sent on June 22, 2021. 

He further claims that Tamko is in violation of the Deceptive Trade Practices Act for falsely representing that "goods and services are of a particular standard, quality or grade." 

Eichenour seeks monetary relief of less than $75,000,  interest and all other just relief. He is represented by William Green, III of WTGreen PLLC in Houston.
