Surgeon faces $1M suit claiming he negligently performed back surgery on patient

HOUSTON — A surgeon is facing a claim that he negligently peformed back surgery on a patient. 

John Allen Mann filed a complaint Sept. 24 in Harris County District Court against Neil Badlani, M.D., alleging negligence. 

According to his complaint, Mann underwent an "L4-5 lumbar laminectomy" on July 29, 2020, peformed by Badlani. He claims that after his surgery he continued to suffer a "considerable amount of pain that was affecting his everyday life." Mann alleges that after seeking an evaluation from a neurosurgeon, the surgeon concluded his back surgery was "done at the wrong level." 

He further claims he had to undergo additional surgeries and treatment and suffers from chronic back pain. Mann alleges Badlani's negligence for failing to do a proper diagnostic study before the surgery, make a diagnosis, conduct a physical exam or perform the surgery on the correct site. He also alleges Badlani performed a medically unnecessary surgery. 

Mann seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Mark Weyger and Elena Bueno of The Weycer Law Firm PC in Bellaire.
