HOUSTON — A couple claim they and their minor child suffered serious injuries in a rear end collision on Interstate 45 with the at-fault driver leaving the scene before police arrived.

Roman Garcia and Kenia Aguilar filed a complaint Sept. 24 in Harris County District Court against Angaf Solutions LLC and Laquiesha Shantell Duncan alleging negligence.

The plaintiffs claim that on Aug. 27, 2021, they and their minor child were seriously injured after their Mercedes Benz was "violently" rear-ended on Interstate 45 by a Angaf Solutions medical transport van driven by Duncan. Specifically, the plaintiffs claim they slowed their vehicle down as they approached traffic in the far-right lane.

They allege after Duncan hit them from behind, they were thrown forward and then jerked backwards and then sideways which caused injuries to their necks, backs and arms. The plaintiffs further allege that after the crash, they spoke with Ducan's boss who asked them not to call the police and also offered to pay for the property damage . The plaintiffs also allege that Duncan's boss stated the van brakes were not "working that good." They claim Duncan left the scene of the accident before police arrived.

The plaintiffs seek monetary relief of more than $1 million, trial by jury and all other just relief. They are represented by Anthony Buzbee and David Bergen of The Buzbee Law Firm in Houston.
