Pallet falls off forklift and onto customer at Floor Liquidators, suit claims

HOUSTON — A man alleges a pallet fell off a forklift and landed on top of him as a Floor Liquidators employee attempted to load materials into his vehicle. 

Hector Melendez-Solis filed a complaint Sept. 27 in Harris County District Court against Floor and Decor Outlets of America Inc., doing business as Floor Liquidators Inc., alleging negligence. 

The plaintiff was a customer at the defendant's store located on Hempstead Road in Houston on June 26, 2021. He claims that as he was picking up materials, an employee of the defendant moved the materials on a pallet and then moved the pallets with a forklift. 

The plaintiff further claims that as the employee was moving the materials onto his vehicle, the pallet was not grabbed correctly by the forklift, came off the forklift and fell on top of him. He alleges that he suffered serious injuries and incurred medical expenses as a result of those injuries. 

The plaintiff claims Floor Liquidators failed to maintain the forklift and pallets in a safe condition and failed to inspect the equipment. He also claims Floor Liquidators failed to take proper precautions, train its employee forklift driver and was negligent for failing to warn of the dangerous condition. 

The plaintiff seeks monetary relief of no more than $250,000 interest and all other just relief. He is represented by Jesus Salinas of The Daspit Law Firm in Houston.
