Worker injured by defective tractor cable claims negligence

HOUSTON — A worker whose arm was pulled by a defective tractor winch cable is claiming his employer's negligence. 

Russel Waddell filed a complaint Oct. 4 in Harris County District Court against Tidal Tank Inc., alleging negligence. 

According to his complaint, Waddell was working for Tidal Tank on June 11, 2020, and was told to operate a tractor. He claims while operating the tractor, the tractor winch malfunctioned and pulled his arm "suddenly and violently" and caused him to suffer severe injuries. 

Waddell alleges that Tidal Tank was negligent for not instituting or enforcing proper safety programs and failed to warn and instruct him. He also claims he was provided defective equipment to perform his work and that Tidal Tank did not inspect and repair its equipment. Waddell claims that he has suffered lost wages, physical impairment and incurred medical and nursing care expenses as a result of the accident with the malfunctioning tractor. 

Waddell seeks monetary relief between $200,000 and $1 million, interest, trial by jury and all other just relief. He is represented by J. Moises Cedillos of The Cedillos Law Firm PLLC in Houston.
