Suit alleges nursing facility's lack of staff caused patient's fall, broken hip

HOUSTON — The estate of a patient who suffered a fall and broken hip at a nursing facility in Humble is alleging a lack of proper staffing led to negligent care.  

Jerry Presswood, individually and as the proposed administrator of the Estate of Willie M. Presswood filed a complaint Oct. 11 in Harris County District Court against Winnie-Stowel Hospital District, HMG Services LLC, HMG Park Manor of Humble LLC and HMG Healthcare LLC alleging medical negligence, liability and other claims. 

According to the plaintiff's complaint, Willie Mae Presswood was admitted to Park Manor of Humble's nursing facility on Oct. 8, 2019, and was admitted as a fall risk.  He claims that the defendants failed to have sufficient and qualified staff which resulted in Willie Mae Presswood's fall and suffering a broken hip on Oct. 18, 2019. 

The plaintiff further alleges that Willie Mae underwent a partial surgical repair of her hip on Oct. 21, 2019, and failed to recover from the hip fracture and died on Dec. 29, 2019. He claims the defendants were negligent for failing to provide the level of care Willie Mae Presswood required and that the defendants' managerial and operational control over the facility including staffing and funding, had a direct impact on her care. 

The plaintiff also claims the defendants failed to maintain a complete chart and notify the physician of changes in Willie Mae's condition. 

The plaintiff seeks monetary relief, interest and all other just relief. He is represented by William Barfield and Kevin Cox of McDonald Worley PC in Houston.
