Homeowner claims delays, plumbing, flooring issues due to contractor's negligence

HOUSTON — A homeowner alleges her contractor's negligence caused a seven month project delay, plumbing, flooring, draining and other issues with her new home. 

Donna Roth filed a complaint Oct. 11 in Harris County District Court against Carroll Homes LLC, Ronny Carroll Homes Inc., & Lumber Liquidators Inc., alleging breach of contract, neglience and other claims. 

According to Roth's complaint, she entered into a contract with Carroll for the demolition of an existing home and the construction of a new 3,132 square foot residence in the summer of 2017. She claims Carroll did not began demolition until January of 2018, and did not lay the foundation until April of 2018, which was seven months past the contracted completion date. 

Roth also claims the delay caused her $12,250 in additional rent and that the work done by Carroll had multiple issues including the toilets not flushing properly and flooding due to an overflowed toilet. She alleges the house also had issues with drainage, pool pipes, wood flooring that was peeling and cupped, improperly installed appliances, and stucco issues for a total of at least $100,000 to repair. 

Roth seeks monetary relief of more than $250,000, interest and all other just relief. She is represented by Matias Adrogue and Lelia El-Hakam of Matias J. Adrogue in Houston.
