Chuy's faces negligence claim after customer's slip, fall at restaurant in Humble

HOUSTON — Chuy's is facing a suit after a customer slipped and fell at its Humble restaurant and suffered severe injuries. 

Rosa Hernandez filed a complaint Oct. 20 in Harris County District Court against Chuy's Opco Inc., alleging negligence and premises liability. 

Hernandez was at the Chuy's on Highway 59 in Humble on Nov. 16, 2019, according to her complaint. She claims that suddenly and without warning, she slipped and fell on "an object" that was on the floor and suffered injuries. Hernandez claims Chuy's negligence for failing to maintain its premises in a safe condition and failing to implement safety and health policies and procedures. 

She also claims Chuy's failed to exercise ordinary care to protect him from danger and did not warn of the danger. Hernandez alleges as a result of her slip and fall, he suffered mental anguish, lost earnings, impairment and disfigurement. 

Hernandez seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Brent Cordell and Antone Petersen of Smith & Hassler in Houston.
