Anytime Fitness member injured when workout bench collapses, $1M suit claims

HOUSTON — Anytime Fitness is facing a suit after a guest was injured when a workout bench collapsed to the floor. 

Antonio Russo filed a complaint Oct. 19 in Harris County District Court against T&J P.U.S.H., LLC doing business as Anytime Fitness and Joannah Contreras alleging premises liability and negligence. 

Russo alleges in his complaint that he was at Anytime Fitness on Minonite Road in Rosenburg on July 13, 2021. He claims as he was using a workout bench, the bench broke, fell to the floor and caused him to suffer injuries. Russo alleges Anytime Fitness' negligence for failing to warn of the dangerous condition and providing inadequate equipment. 

He further alleges Anytime Fitness failed to implement adequate policies and procedures and that they should have know of the condition of its equipment and the risk of unreasonable harm. Russo claims as a result of the broken workout bench, he suffered disfigurement, lost earning capacity and incurred medical treatment expenses. 

Russo seeks monetary relief of $1 million, interest, trial by jury and all other just relief. He is represented by Thomas Thurlow and Chance Marshall of Thomas N. Thurlow & Associates PC in Houston.
