HOUSTON — A man alleges the used vehicle he purchased from a Houston auto dealer was defective.
Christopher Canon filed a complaint Oct. 18 in Harris County District Court against Sommer Investments LLC doing business as Texas Auto and Modern Diesel Legion LLC alleging breach of contract, fraud and other claims.
Canon purchased a 2012 Dodge Ram from Texas Auto for $35,696 on Feb. 26, 2020, according to his complaint. He claims that less than 15 minutes after purchasing the Dodge, both passenger side wheels suddenly became detached as he drove down the road. Canon alleges he also noticed a crack in the vehicle's return engine line which caused "large amounts" of engine oil to leak onto the pavement.
He further alleges that he had the car towed back to the dealership and that Texas Auto would only reattach the rear wheels but refused to repair the cracked oil line. Canon claims that in May of 2020, the Dodge's oxygen intake pipe malfunctioned and led to the engine constantly overheating and that two weeks after that, the vehicle's transmission completely failed. Canon also claims that in June of 2021, nearly a year after the car had been sent to Texas Auto's third party repair shop, they ceased repair work and invoiced him for $17,764.95.
Canon seeks monetary relief, interest and all other just relief. He is represented by Leslie Adams, Angelle Adams, Partrick Alvarez and Guy Bily of Leslie Wm Adams & Associates in Houston.
