Former B&W Energy employee alleges he is owed more than $129,000 in unpaid commissions

HOUSTON — A former B&W Energy sales rep alleges the company owes him more than $129,000 in unpaid commissions. 

William Martin filed a complaint Oct. 27 in Harris County District Court against B and W Energy Services Inc., alleging breach of contract.

Martin worked as a business development and technical sales representative for B&W from May 2011 until his resignation in June of 2021. He alleges that under his sales commission plan, he was entitled to a commission between 0.5% and 1.0% for each project sold and that during his tenure, B&W began giving him a 1.25% commission for some projects. 

He further alleges that B&W was legally obligated to pay the sales commission on a quarterly basis and that he only received partial commission for some projects. Martin claims B&W owes him for $129,439.27 in unpaid commissions for those projects. 

Martin seeks monetary relief of less than $250,000, interest, trial by jury and all other just relief. He is represented by Kerry O'Brien of The O'Brien Law Firm in Austin.
