Pipe fitter falls off furnace scaffolding at Chevron Phillips refinery, sues for $1M plus

HOUSTON — A pipe fitter who fell off a scaffolding inside a furnace at a Chevron Phillips oil refinery is claiming negligence. 

Roy Montalvo filed a complaint Oct. 26 in Harris County District Court against Chevron Phillips Chemical Company LP and others alleging negligence. 

Montalvo was working as a pipe fitter inside a furnace at the defendants' oil refinery on Nov. 12, 2020, according to his complaint. He alleges that as he was on the scaffolding inside the 45 foot tall furnace and attempting to replace the furnace's tube sheet, he fell 20 feet. 

Montalvo claims as a result of fall, he suffered injuries to his back, hand, leg, foot and other parts of his body. He further claims the defendants' negligence for failing to properly train their employees, have proper safety equipment and failed to keep the work site free of slip hazards and debris. He also claims the defendants failed to have adequate lighting, provide medical equipment or warn of the unreasonably dangerous condition. 

Montalvo seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Jason Itkin, Cory Itkin and Michael Darling of Arnold & Itkin LLP in Houston.
