Suit: Home health nurse's improper trach tube leads to two year old's death

HOUSTON — A home health care nurse is being accused of improperly placing a trach tube in a two year old which led to her death. 

DeAndra Douglas, individually and as representative of the Estate of N.J., deceased filed a complaint Nov. 3 in Harris County District Court against Aveanna Healthcare LLC alleging negligence and wrongful death. 

According to Douglas' complaint, her two year old daughter N.J. suffered from a rare disorder which cause her to have underdeveloped lungs and required a ventilator since birth to breathe. She alleges that while she worked during the day, she contracted with Aveanna Healthcare to provide home health care for her daughter beginning in July of 2019. 

Douglas claims that on October of 2016, her daughter was in "excellent" health when she left her under the care of Ashorm, a licensed vocational nurse. She further claims that when Ashorm replaced N.J.'s trach tube, she failed to successfully put the tube into N.J's airway and that N.J. was pronounced dead on arrival at Texas Children's Hospital Emergency Room. 

Douglas seeks monetary relief between $5 million and $10 million, interest and all other just relief. She is represented by Robert Lapin of Lapin & Landa LLP in Houston.
