Woman alleges crack on sidewalk caused her fall at Houston condo complex, sues for $1M

HOUSTON — A woman who fell on a crack on the sidewalk at her Houston condo complex and suffered injuries is claiming negligence. 

Helen Rodriguez filed a complaint Nov. 10 in Harris County District Court against Creative Management Company alleging premises liability and negligence. 

According to her complaint, Rodriguez was a resident at the defendant's Waterman Crossing Condos on Wunderlich Drive in Houston. She alleges that on Aug. 1, 2020, she was walking at the condos when she tripped and fell due to a large crack in the sidewalk and suffered injuries. Rodriguez alleges that the defendants were negligent for failing to correct the unreasonably dangerous condition and failed to warn of the hazard. She also alleges the defendants failed to properly inspect their premises, train their employees in handling an emergency and failed to implement proper safety procedures and policies. Rodriguez also alleges the defendants failed to supervise or have a first aid kit or other medical equipment to use in case of an emergency. 

Rodriguez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Matthew Mendoza and Tej Paranjpe of Paranjpe Mahadass Ruemke LLP in Houston.
