Patient alleges surgeon accidentally cut off blood supply to her kidney, sues for $1M plus

HOUSTON — A patient alleges her physician accidentally cut off the blood supply to her right kidney during a surgery. 

Eva Ackerman filed a complaint Nov. 10 in Harris County District Court against Davood J. Abollahian, M.D., alleging medical negligence. 

Ackerman alleges in her complaint that on Dec. 1, 2020, Abollahian "negligently destroyed" her right kidney which resulted in ongoing medical problems and will require the eventual removal of the kidney. Specifically, Ackerman alleges that she was diagnosed with a benign tumor and while the defendant was cutting off the blood supply to a benign growth on her kidney, he cut off the supply to the entire right kidney. 

Ackerman, who was awake for the procedure, claims that Abollahian displayed "cavalier, inappropriate and overly excited" behavior to the physician residents during the surgery. She claims that as a result of the defendant's negligence, she suffered severe pain, uncontrollable hypertension, loss of work as a company scientist  and will "need to have the dead right kidney removed at a future date." 

Ackerman alleges the defendant failed to provide her with complete and accurate information on the procedure and among other claims, failed to promptly attend to her medical needs. 

Ackerman seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Stephen Barnes, M.D., JD, FACLM of Barnes & Associates in Houston.
